Terms and Conditions
1. Scope of Application
1.1. These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded between you (hereinafter "Customer") and us, Higher Coffee Concept, Moltkestraße 31, 40477 Düsseldorf, sole proprietorship, represented by Vladimir Goncharenko (hereinafter "Seller"), for the purchase of goods (roasted coffee beans) in our online shop at highercoffee.co.
1.2. These GTC apply exclusively. Deviating or supplementary conditions of the Customer shall not become part of the contract unless we expressly agree to their validity in writing.
1.3. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a legal partnership that, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
2. Conclusion of Contract
2.1. The presentation of the goods in our online shop does not constitute a legally binding offer, but an non-binding invitation to order.
2.2. You can submit a binding offer by placing the desired goods in the shopping cart, going through the ordering process, accepting the GTC and clicking the "order with obligation to pay" button. Before submitting the order, you can check and correct your entries at any time.
2.3. After receiving your order, we will send you an automatic order confirmation by email, which confirms receipt of your order but does not yet constitute a conclusion of contract. The purchase contract is concluded when we accept your offer by an express order confirmation (by email) or by shipping the goods within five days.
2.4. The contract text will be stored by us and sent to you by email together with these GTC after the conclusion of the contract. If you create a customer account, you can view the contract text there.
2.5. The contract language is German. Order processing takes place via email and automated processes. Please ensure that the email address you provide is correct and that our emails can be received (e.g., by checking your spam filter).
3. Right of Withdrawal
3.1. As a consumer, you have a statutory right of withdrawal of 14 days. Detailed information can be found in our cancellation policy.
3.2. The right of withdrawal does not apply to:

Goods that have been specifically roasted to order or are perishable (e.g., freshly roasted coffee).

Sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
3.3. If you exercise your right of withdrawal, you shall bear the costs of returning the goods, provided that the delivered goods correspond to those ordered and are not defective.
3.4. In the event of an effective withdrawal, we will refund the purchase price within 14 days of receiving the goods back. You are obliged to return the goods to us immediately, at the latest within 14 days of declaring the withdrawal.
4. Prices and Payment Terms
4.1. All prices in our online shop are total prices in Euro and include the statutory value-added tax. Additional shipping costs are clearly indicated in the product description or during the ordering process.
4.2. The following payment methods are available to you:

PayPal: You will be redirected to the PayPal website, where you can log in or create an account and confirm the payment.

Credit card (Mastercard, Visa, Amex): After entering your credit card details, the payment will be automatically initiated after the order is completed.

Apple Pay: You can pay quickly and securely with your Apple device.
4.3. Payment is due immediately after the conclusion of the contract, unless otherwise stated. In the event of late payment, we will charge the statutory default interest and reserve the right to claim further damages caused by delay.
5. Delivery and Shipping Conditions
5.1. Delivery will be made to the delivery address you provided within Germany. Shipping will take place no later than three working days after receipt of payment.
5.2. Should delivery not be possible (e.g., due to an incorrect address), you shall bear the costs for re-shipping, unless you are not responsible for the circumstance.
5.3. We are entitled to make partial deliveries if this is reasonable for you. This will not incur any additional shipping costs for you.
5.4. In the event of transport damage, we ask you to report it immediately to the delivery agent and inform us at info@highercoffee.co. This does not affect your statutory rights but helps us assert claims against the transport company.
6. Retention of Title
6.1. The delivered goods remain our property until full payment of the purchase price.
6.2. For entrepreneurs: We reserve ownership of the goods until all claims from the business relationship have been paid in full. The customer may resell the reserved goods in the ordinary course of business.
7. Liability for Defects
7.1. The statutory warranty rights according to the German Civil Code (BGB) apply.
7.2. For defective goods, we bear the costs of return and offer you either a replacement delivery or a refund of the purchase price.
7.3. Please check the goods for obvious defects or transport damage upon receipt and inform us immediately at info@highercoffee.co. This does not affect your statutory claims.
8. Liability
8.1. We are liable without limitation for damages caused by us, our legal representatives or vicarious agents intentionally or through gross negligence, as well as for damages resulting from injury to life, body or health, in the event of assuming guarantees or according to the Product Liability Act.
8.2. In all other cases, we are only liable for the breach of essential contractual obligations (cardinal obligations) and only for foreseeable, typical damages. Any further liability is excluded.
8.3 We grant a 6-month warranty on our electrical appliances from the date of receipt. Please report defects within 7 days of discovery. In the event of a warranty claim, a repair or replacement will be carried out after inspection. The warranty covers material and manufacturing defects and excludes damage caused by improper use, normal wear and tear, or external influences. For processing, we require the order number and a brief description including a photo or video.
9. Data Protection
9.1. We process your personal data (e.g., name, address, email, payment data) exclusively for contract processing and in accordance with the statutory data protection regulations.
9.2. Further information can be found in our privacy policy.
9.3. You have the right to information, correction, deletion and blocking of your personal data, provided that there are no legal retention obligations to the contrary.
10. Applicable Law
10.1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, mandatory provisions of the country in which the consumer has their habitual residence remain unaffected.
11. Place of Jurisdiction
11.1. For merchants, legal entities under public law or special funds under public law, the place of jurisdiction is our registered office. However, we are also entitled to sue the customer at their general place of jurisdiction.
11.2. For consumers, the place of jurisdiction of their domicile applies to claims against us. For claims by us against consumers, our registered office applies.
